Case Summary
Under dark conditions in a rural area, insured's tractor trailer combination attempted a u-turn through a median break. The truck driver saw headlights approaching in the distance, but thought they were far enough away so he could complete his turn. The trailer was across both lanes when plaintiff's car under-rode the trailer just forward of the rear tandems. There was no physical evidence that plaintiff was approaching in excess of the posted 55 mph speed limit.
Presentation Results
The case settled on terms very favorable to the insured at a pre-suit mediation. The strategic liability presentation clearly demonstrated the opportunity a reasonably alert driver had to see the turning truck and avoid a collision. The presentation also justified insured's decision to make the u-turn by showing that plaintiff was probably speeding close to 80 mph, which best explained the conduct of both drivers.

Case Summary
Insured's dump truck and plaintiff's motorcycle, which were heading in opposite directions, collided while passing each other in the curve of a two-lane road. The only contact between the truck and the motorcycle occurred when the left handlebar of the motorcycle hit the rear edge of the dump truck bed. The plaintiff lost fingers on his left hand during the initial impact, and a portion of his left leg in a collision that followed with another vehicle. No point of impact evidence was created on the road surface to establish who went left of center.
Presentation Results
The jury returned a defense verdict. The strategic liability presentation created clarity about the accident events so the jury could choose rightly between contradictory testimony. I watched the jurors as they watched the animations in the presentation. They were nodding in agreement.
